Vigilance has also recommended “fixing the responsibilities of the concerned officers of the Education Department and Public Works Department (PWD)” allegedly involved in the nearly Rs 1,300 crore scam.

Officials said the department has also recommended sending its findings to the Central Vigilance Commission (CVC) for consideration along with the responses of the PWD and the Education Department.

In a report dated February 17, 2020, the CVC had identified glaring irregularities in the construction of additional classrooms in Delhi government schools by the PWD. It had sent the report to DOV and sought its comments on the matter, officials said.

In August, Delhi Lt. Governor Vinay Kumar Saxena asked the Chief Secretary to conduct an inquiry into the state vigilance’s delay in taking up the matter, and submit a report in this regard.

According to sources, PWD, which is the executing agency of the project, allegedly violated rules and regulations, General Financial Rules to rig the tender process.

“Private persons viz. M/s Babbar & Babbar Associates, who attended the meeting in the chamber of the then PWD Minister on 21.06.2016, directed to add further clarifications on their advice. The Vigilance Secretary in his report also observed that “extra-constitutional agencies/individuals (like Babbar and Babbar Associates) were running the administration and dictating terms and conditions to officers”. Further, the vigilance report highlighted that the tendering of a high-cost project with an estimated cost of Rs 989.26 crore was done without preparation of detailed estimates and technical specifications for each school. and without giving sufficient time to bidders to submit bids. Such a practice would “dissuade serious bidders” from the tendering process.

The report said that work worth Rs 42.5 crore in five schools was awarded to contractors without calling for open tenders. This savings was to be used for new works without open tender.

Further, he pointed out that 1,214 toilet blocks were constructed against the requirement of 116 toilet blocks, resulting in an additional expenditure of around Rs 37 crore.

The CVC report also said that the total cost of the project was Rs 989.26 crore and the award value of all tenders was Rs 860.63 crore, but the actual expenditure went up to Rs 1,315.57 crore.

An inquiry into the construction of the classrooms was initiated after a complaint lodged by BJP leader Manoj Tiwari in 2019.
