Islamabad: The Supreme Court has issued notices to PTI President Imran Khan, Asad Umar and Fawad Chaudhary in the contempt case of the Election Commission.
As per the details, a 3-member bench headed by Chief Justice Omar Atta Bandyal heard the contempt case of the Election Commission, the court issued notices to former prime ministers Imran Khan, Fawad Chaudhry and Asad Umar, and issued notices to the Election Commission. Ordered an injunction. It has also been ordered to fix the appeals for hearing.
The court had remarked that the position of the Election Commission was to prepare or fight the local and general elections. , The Election Commission has requested to transfer the cases pending in various High Courts to one High Court. The EC has also cited judicial precedents for consolidation of cases with the Supreme Court order. The court has postponed the hearing of the case for 15 days. Chief Justice Umar Atta Bandyal said that the Election Commission is relying on Article 186A and is there any precedent of Supreme Court judgment to consolidate cases of different High Courts?
The counsel for the Election Commission said that the Supreme Court had in 1999 ordered the consolidation of income tax cases pending in various high courts. The Chief Justice said that it is necessary to link the cases pending in different High Courts from one legal point. To which the counsel for the Election Commission replied that Imran Khan, Fawad Chaudhary and Asad Umar have filed a case against the Election Commission in the High Court.
Justice Ayesha Malik remarked that the Supreme Court has declared in PEMRA cases that the cases of the High Courts will not be consolidated. The order of the High Court in the contempt of the Election Commission has also been challenged in the Supreme Court.
Justice Ayesha Malik said that when conflicting decisions come in the Supreme Court, the verdict will be pronounced. Justice Athar Manullah observed that the Supreme Court has consolidated all the cases of the High Courts in the matter of Haj assistants.
