A Sudbury, Ont., woman alleges police falsely implicated her in her husband’s death.

The estranged wife of a man killed in 2020 is filing a joint $8 million lawsuit against her brother-in-law, police officials and the Ministry of Community and Correctional Services.

Melissa Sheridan, Sudbury, Ont. In November 2020, she was charged with murdering her estranged husband, 56-year-old Brant Burke.

Killarney, Ont. Kay Kelly Burke pleaded guilty to her brother’s second-degree murder. On October 26, 2022, he was sentenced to life in prison with no parole eligibility for 15 years.

Brent Burke was found dead on a trail in the Point Grondine Reserve within the Wiikwemkoong Unceded Territory on October 25, 2020.

In a statement of claim, Sheridan’s attorneys, Michael Lacey and Justin Linden, said she was falsely accused and arrested for her estranged husband’s murder.

“Ms. Sheridan’s arrest and prosecution was directly attributable to the misconduct and/or negligence of members of the Ontario Provincial Police (OPP) and Wikwemikong Tribal Police, which led to the creation of a false statement by the original perpetrator, Kerry Burke.” falsely implicating Melissa in the murder of Brent Burke,” the statement of claim said.

The allegations and the case have not yet been proven or tested in court.

The Sheridans, along with their children and elderly parents, are seeking $2 million in general damages, $2 million in special damages, $2 million in enhanced, punitive and exemplary damages, and $2 million in Family Law Act damages.

Prior to Nov. 25, 2020, Sheridan had no criminal record and was a reputable business owner, the statement of claim states.

“As a result of the murder allegations, and the resulting publicity, Melissa’s company, CRCS, suffered a significant loss of anticipated revenue in the coming period,” her attorneys wrote.

He added that Sheridan became an outcast in the community and his family faced derogatory comments on social media.

“As a result of the events described herein, Melissa Sheridan has suffered serious and permanent injuries, damages and losses including depression, anxiety, physical and emotional trauma, loss of reputation, stigma, and loss of past, present and future income and a competitive Loss of benefit,” the statement of claim said.

The statement of claim accuses police officers with the OPP and Wikwemikong Tribal Police of incompetence and alleges they pressured Carrie Burke to falsely implicate her sister-in-law in her brother’s murder.

“They fed Carrey a narrative aimed at implicating Melissa in the murder while helping her to iron out inconsistencies and fill in gaps in her story,” the statement of claim states. “

As of 24 November 2022, the statement of defense has not yet been filed.

“This has been a nightmare for Ms. Sheridan and her children,” her attorney, Justin Linden, told CBC News in an email.

“We look forward to taking the evidence before the court to ensure this never happens again.”
