Nagpur. An application was made on behalf of Seven Star Hospital, Prania regarding breach of contract between Pranias and M/s Lata Kisan Construction Company. Due to the lack of decision on this, now the High Court had to be approached. After hearing the petition filed by the hospital, Justice Atul Chandurkar and Justice Varushali Joshi ordered Pranias to decide on the petition. Right of Petitioner Shri Rang Bhandarkar and Ors. Sejal Lakhani and Pranayas Udhi. Advocated by Sudhir Parank. It was stated on behalf of the petitioner that a concession agreement was entered into between the trust and the construction company on 29th April 2014 which is being violated.
Decide according to the rules
It was stated on behalf of the petitioner that an application was made to the Trust on January 6, 2023, drawing the attention of the authorities to the violation, as well as requesting appropriate action. But till now, the trust has not taken notice of this request.
The court, after considering the petition after hearing, said that in this context orders can be given to decide according to the rules. During the hearing, the counsel for the trust present in the court was ordered to accept the notice. Also, instead of seeking a response from the construction company, the court ordered Pranias to hear the petition.
In the order, the court said that during the hearing, Trust Construction Company and other defendants are also free to be heard. The court ordered the trust to take the necessary decision within 4 weeks and provide information regarding the decision to both the parties.
